Introduction
The Tabung Haji Cambodia program is established by CATA to enable members of the Cambodian Muslim community to save funds with CATA specifically for performing Hajj in accordance with Islamic principles.
Objectives
- To enable Cambodian Muslims to prepare financially for Hajj/Umrah in an organized and affordable manner.
- To ensure funds are managed in a transparent and halal way.
- To strengthen community solidarity through cooperative savings.
Eligibility
- Must be a Muslim residing in Cambodia.
- Minimum age: 18 years old (or with parent/guardian consent if younger).
- Must be a registered member of CATA.
Account Structure
- Type of Account – Wadiah Yad Dhamanah (Safe-keeping with guarantee) or Mudharabah (profit-sharing) depending on investment option chosen by CATA.
- Minimum Initial Deposit – USD $50.
- Monthly Savings – Minimum USD $30 (members may save more at any time).
- Currency – All deposits are in United States Dollars (USD).
Savings Period
- Members may save until they reach the target amount for Hajj/Umrah as set by CATA each year.
- Example: Hajj package cost for the year is $6,000; members continue saving until reaching this amount.
Fund Management
- All funds are placed in Shariah-compliant accounts or halal investment portfolios.
- No funds are invested in activities involving alcohol, gambling, riba, or any non-halal business.
- CATA will maintain annual audited statements for transparency.
Profit Sharing (if applicable)
- Ethical investment mechanisms to grow participants’ savings through halal ventures, providing additional financial benefits to savers while adhering to Islamic principles
Withdrawal Policy
- Funds may only be withdrawn for Hajj/Umrah purposes unless in case of:
a) Medical emergency
b) Death of member (funds given to heirs) - Early withdrawals for non-Hajj purposes may be subject to account closure.
Hajj Arrangement
- When a member reaches the required savings and obtains a visa/quota, CATA will coordinate with licensed Hajj travel agencies for package booking.
- Priority is given to members who have saved the longest and completed requirements.
Hajj Badel Benefit
- Coverage for participants who pass away before performing Hajj, where CATA will arrange for Hajj Badel (Hajj performed on behalf of the deceased). Or
- Provide the heirs with 70% of the total savings fund, ensuring the participant’s religious obligation is fulfilled even after death.
Membership Termination
- CATA reserves the right to terminate membership if:
a) Member engages in fraudulent activities
b) Member violates program terms - Termination will result in a return of all savings minus any outstanding obligations.
Missed Payment & Account Maintenance
- Grace Period – Members have a grace period of three (3) months to catch up on missed payments.
- Notification – CATA will contact the member via phone, message, or official letter to remind them of missed contributions.
- Suspension – If no payment is made for more than six (6) consecutive months without notice, the account will be placed under “inactive” status and will lose Hajj quota priority.
- Reactivation – An inactive account can be reactivated at any time by paying the missed months in full or adjusting the payment plan with CATA’s approval.
- Permanent Closure – If no payment is made for twelve (12) consecutive months, CATA reserves the right to close the account and return the member’s balance minus administrative costs of 30%.
- Special Circumstances – Members facing genuine hardship (loss of job, illness, etc.) may request a temporary suspension without penalty, subject to approval by CATA’s management and Shariah Advisory Committee.
Dispute Resolution
- All disputes will be resolved amicably through internal mediation under CATA’s Shariah Advisory Committee.
- If unresolved, matters will be referred to the competent court in Cambodia.
Amendments to Terms & Conditions
- CATA reserves the right to amend these terms and conditions at any time with proper notification to members.
- Major changes will be communicated directly to members via official channels at least 30 days before implementation.
- Members who disagree with changes may withdraw their funds according to the withdrawal policy stated above.
Privacy and Confidentiality
- CATA commits to protecting the privacy and confidentiality of all member information.
- Member information will only be shared with relevant authorities for Hajj/Umrah visa processing or when required by law.
- Members may request access to their personal information at any time.
Force Majeure
- CATA shall not be liable for delays or failures in performance resulting from acts beyond its reasonable control, including but not limited to acts of God, pandemic, governmental actions, or natural disasters.
- In such circumstances, CATA will make reasonable efforts to accommodate members’ needs.
